Smart Target Mobile Application Terms and Conditions

Introduction 

These Terms and Conditions (the „Terms”) define the rules for using the Smart Target mobile application, available on devices with iOS and Android operating systems. Before starting to use the Application, please read its content carefully. Use of the Application signifies acceptance of the following terms.

  1. Company Information

  1. Definitions

 Application – the Smart Target mobile application. User – a natural person using the Application. Services – the functionalities available within the Application. Stores – mobile application distribution platforms, such as Google Play Store (for Android) and Apple App Store (for iOS).

  1. General Conditions for Using the Application

The Application is available for download in the Stores worldwide. The basic functions of the Application are available free of charge. Use of the Application requires a mobile device with Internet access. The User agrees to use the Application in accordance with applicable law, these Terms, and good practice. Any actions that could disrupt the functioning of the Application or violate the rights of other Users are prohibited.

  1. Subscription Payments

Some advanced features of the Application may be available through a paid subscription. Payments for subscriptions are made exclusively through the Stores (Google Play Store for Android and Apple App Store for iOS). Smart Target Sp. z o.o. does not directly process any payment data of the User. All transactions are handled by the Stores in accordance with their own payment regulations. The User accepts that the subscription terms, including prices, billing periods, and cancellation rules, are governed by the Stores. There is no possibility to make any additional transactions within the Application other than the subscriptions processed through the Stores.

  1. Liability

Smart Target Sp. z o.o. makes every effort to ensure the Application functions correctly, but does not guarantee its uninterrupted availability or freedom from errors. Smart Target Sp. z o.o. is not liable for damages resulting from improper use of the Application or failures of the User’s mobile devices. Smart Target Sp. z o.o. is not responsible for the actions of the Stores concerning payments and subscription management.

  1. Privacy Policy

Information regarding the processing of Users’ personal data is contained in a separate Privacy Policy of the Application, available in the Application and on the Smart Target Sp. z o.o. website. The User should familiarize themselves with the privacy policy, which takes into account data protection regulations applicable in various jurisdictions, including the GDPR for users from the European Union.

  1. Final Provisions

Smart Target Sp. z o.o. reserves the right to change these Terms at any time. Changes come into effect upon their publication in the Application or on the Smart Target Sp. z o.o. website. The User will be notified of significant changes to the Terms. Continued use of the Application after the changes have been implemented signifies their acceptance. In matters not regulated by these Terms, the provisions of Polish law shall apply. However, in the case of users outside of Poland, local consumer law and data protection regulations that are more favorable to them may also apply. Any disputes arising from the use of the Application will be resolved by the court competent for the seat of Smart Target Sp. z o.o. Provided that, in some jurisdictions, users may have the right to bring a case to local courts in accordance with applicable law.
